Elderly Woman Shoots 12-Year-Old Boy

Boy Is Charged With Crime, Woman Is Not
CHICAGO (CBS) ―


A broken window at the home of Margaret Matthews, 68, whom neighbors said shot a 12-year-old boy who had been "terrorizing" her.

A shooting on the city's Southeast Side has people telling two entirely different stories.

Neighbors said an elderly woman was fed up with constant harassment from a 12-year-old boy, so she took a gun and shot the child after he and his friends threw bricks into her home.

Now, the boy is charged with a crime, while the 68-year-old woman is not.

The boy who was shot, along with another boy, 13, are cited in juvenile delinquency petitions with one count each of misdemeanor aggravated assault to a senior citizen, according to police.

The woman, identified by neighbors as Margaret Matthews, was released from police custody without being charged, on the grounds that she acted in self defense, police said.

The boy who was shot was out of the hospital as of Wednesday morning, and was released to his parents, police said.

Margaret Matthews appeared to be home this morning when we stopped by. But she wasn't talking. However, numerous neighbors have been speaking in her defense.

The shooting happened near 76th Street and Coles Avenue. Afterward, neighbors said Matthews was distraught because of everything that led up to the trigger-pull.

"She was very emotional; she was an emotional wreck,'' said a neighbor, Troila McCoy.

Neighbors said the boy was the ringleader of a group of kids, and had been holding his own little reign of terror on the block – especially targeting Matthews.

"I call him the little bad boy," said another neighbor, Hilda Brunt.

McCoy said the boy had been breaking windows, breaking items on Matthews' shed house, and setting her garbage on fire.

"I would say they were bullying her," added neighbor Frenchie Johnson. "She was an older lady. She stayed there by herself. They know that. And she's one of the ladies that, she stands up for herself."

Asked if he supported Matthews' actions, Johnson emphatically said, "Yes."

Damage from the alleged vandalism was apparent in the form of a boarded-up window at the home of the woman.

Neighbors say when the boy threw the bricks and broke Matthews' windows, she simply hit the breaking point.

"They threw a brick through her window," neighbor Rafael Ramirez said Wednesday. "I think she gave them as much warning as I think she could."

She called police and they came, but after officers left, the boy came back. That was when Matthews responded with gunfire.

But the boy's own family has a completely different story.

"He and his friend were walking down the street, and they saw a window broken at a woman's house, and as they passed by, they said she came out shooting," said the boy's grandmother, Donna Virges.

Other neighbors echoed the boy's grandmother's comments.

"I talked to (the boy) on the phone in the hospital," said neighbor Tania Outlaw. "He said that he was just walking past with two other boys... and the lady started shooting."

"All we heard was the shots, and she came out. (The boy) was like, 'She shot me! She shot me!'" said neighbor Rhonda Jackson. "He wasn't the type of little boy to do that; to throw a brick in an old lady's window like that."

Other neighbors said Matthews' actions did not amount to self-defense, but attempted murder of a child.

"If you're directly shooting and she's running, you were trained to kill him, so she would have killed them," said neighbor Jacyrha Cahn. "She was defending herself? I'm just saying, was she defending herself? No."

Regine White is angry that Matthews wasn't charged with a crime.

"She could have threatened them and said, 'I'm going to call the police,' but the fact that she just hauled off and shot them – that was unnecessary," White said.

Still, the incident struck a nerve with some, as a desk officer at the South Chicago police district where the shooting happened said at about 11 p.m. Tuesday, he fielded a call from a concerned citizen who does not know Matthews.

The woman caller wanted to let police know that if needed, she would raise bail money for the woman involved because she "should not go to jail," the officer said.

The caller explained she had also been "terrorized" in a similar way, she "knows what she feels like," and the woman "did the right thing," according to the officer.

WBBM Newsradio 780 reports neighbors say Matthews is a widow, works two jobs and lived in the same home for nearly 30 years. Neighbors know her as "Miss Margaret," WBBM's Lisa Fielding reports.

The boy's charges could land him in juvenile detention for up to a year.

Deaf Texan exonerated of child sex assault freed

(AP) – 17 hours ago

DALLAS — A deaf man exonerated of the rape of a 5-year-old suburban Dallas girl was released Tuesday after 17 years in prison, one day after a judge determined he was innocent.

Stephen Brodie's dad was there to greet the 39-year-old north Texas man when he walked out of the Dallas County jail. Brodie said through an interpreter that he was looking forward to being able to have lunch with his dad, J. Steve Brodie, now that he was out of jail.

Brodie also received an apology from Dallas County District Attorney Craig Watkins, whose office had reopened the case and whose investigation ultimately led to Brodie's exoneration.

A bureaucratic matter had kept Brodie from being released Monday, when a judge ruled Brodie had been wrongly prosecuted despite an absence of physical evidence linking him to the attack. Brodie also was serving prison time for failing to register in Lamar County as a sex offender. With the elimination of his 1993 conviction in the 1990 rape of the Richardson girl, he no longer needed to register and state prison officials signed off on his release Tuesday.

Brodie originally was arrested in 1991 for stealing quarters from a vending machine at a community swimming pool. While he was being questioned about that crime, police began asking about the unsolved rape of the 5-year-old girl a year earlier.

The case was reopened after his father wrote a letter to Watkins' office, which had started a unit dedicated to re-examining possible innocence cases.

Brodie has been deaf since childhood, but police questioned him for hours without an interpreter. He eventually confessed, but later told The Associated Press he felt scared and pressured.

Richardson police said Monday that Brodie initially declined their offer of an interpreter.

When a judge ruled the confession was admissible at trial, Brodie and his attorney figured a guilty verdict, which was punishable by up to 99 years, was all but certain. So they cut a deal — pleading guilty to assaulting the girl in exchange for a five-year sentence. After serving that sentence, Brodie served two more prison stints totaling five more years for twice failing to register as a sex offender.

Brodie was convicted even though a hair and a fingerprint that police believed came from the perpetrator were not a match. Moore said prosecutors failed to notify Brodie's trial attorney that testing showed the hair excluded Brodie as the source.

When Brodie was arrested and convicted, police knew the fingerprint, found on the window through which the perpetrator entered the victim's home, did not match their suspect or anyone living there.

A year after Brodie's conviction, police learned the fingerprint belonged to Robert Warterfield, who pleaded guilty to sexually assaulting a 15-year-old girl in 1994. Warterfield also was suspected by Dallas police in the dozen unsolved sexual assaults and attempted assaults of young girls in the Dallas area.

Warterfield, who is free and working for a yard service in Stephenville, according to the state sex offender registry, was never charged in the attack for which Brodie served time. Watkins has said his office is investigating Warterfield.

Warterfield appeared at Brodie's hearing Monday and invoked the Fifth Amendment right to not provide testimony that might incriminate himself.

Uplashen, Nedjo ustuknu nazad dok ledjima ne napipa zid lifta. Vuchjak je, vidno uznemiren, dahtao i krupne kapi salive su se cedile niz ogromni ruzhichasti isplazheni jezik i jedna po jedna padale na shtrokavi pod lifta, neopran godinama. Lift polako krenu svoj naporni put ka vishim spratovima jedne od "Shest Kaplara", i ovaj pokret nekako uspe da umiri zhivotinju, koja lezhe na zemlju i isprva poche da njushi vrhove Nedjinih cokula civilne zashtite zaduzhenih josh davnog devetog marta '91, da bi se koji trenutak kasnije ogromni pas okrenuo prema drugom uglu lifta ochigledno privuchen mirisom zakorelog urina koji se shirio odatle.

dobro sad, ako sam napisao "redovno" to je knjizevno izrazavanje. Nije se desavalo svaki dan kao kod Miska. Ja se secam da se desilo najmanje 3 puta. 2 x pucali u vazduh, jednom u zemlju pa se metak odbio i povredio dete. Sva 3 puta bilo u novinama.
Tesko naci nesto sto se desilo pre 25-30 godina na internetu, te ne mogu da vam dokazem.

Meni je isto izgledalo jako preterano. Ali covek je obrazovan i to svestrano, pa nisam mogao odmah da diskvalifikujem njegove tvrdnje.
Pitao sam ga da mi poobjasni. Nikakva konspiracija naravno. Kaze jednostavno, kad policija za nekog misli/zna da je kriv za nesto, a ne mogu da to dokazu na sudu iz proceduralnih ili bilo kojih drugih razloga, a ukaze im se prilika nameste mu nesto drugo. Ili ako su (policija) u dealu sa jednim drug-dealerom, a ukaze im se prilika smeste nesto konkurenciji koji nije sticen. Dalje kaze, pogotovo na jugu, je bilo strasno mnogo bull-shit trials protiv crnaca. Ili over-achieving policajci/tuzioci/sudije, bi osudjivali ljude koji nisu imali adekvatnu odbranu. Kaze cesto bi verovatno i sami znali da mozda nije bas 100% kriv za to sto ga optuzuju, ali bi bili uvereni da je kriv za nesto drugo, te bi pravda bila zadovoljena.
Govori o ljudima koji su osudjeni od 50-tih do 80-tih.

Pogledaj samo koliko je nevinih ljudi bilo osudjeno na zivot-smrt, pa su to posle mnogo godina otkrili. A mozes da predpostavis da je tih sto nisu otrkili verovatno jos vise. Ali slazem se, pitanje je da li je taj procenat i blizu 10%. Meni izgleda neverovatno, ali sta ja znam.
